O deputado José Mentor (PT-SP) propôs um projeto de lei em julho deste ano pedindo a proibição de programas de lutas e artes marciais pelas emissoras de televisão no Brasil. O projeto, que foi apresentado à Comissão de Turismo e Desporto (CTD), foi vetado no começo de dezembro, por não ter relação com a comissão. Mas pode ser apresentado a outra comissão, caso queira o deputado.

PASSADO POLÊMICO

O mesmo deputado que hoje parte contra as lutas esteve envolvido em questões polêmicas no passado. No auge da crise do “Mensalão”, seu nome foi apontado pela CPI como um dos favorecidos por Marcos Valério, tendo recebido R$ 120 mil por empresas do empresário.

Mentor, porém, disse que o pagamento foi feito pelo Escritório “Tolentino, Melo e Associados”, por serviços pareceres jurídicos, apesar de a empresa estar ligada à 2S Participações e prestava serviços para Marcos Valério. Segundo a CPI, Mentor não esclareceu a matéria jurídica referente aos serviços prestados.

Das duas uma: ou o deputado José Mentor (PT-SP) é o perseguido preferencial de nove entre dez acusadores surgidos no cenário político recente (e, nesse caso, todos os delitos que lhe são imputados não passam de calúnia) ou tem-se saído muito bem nas tentativas de driblar a lei (hipótese em que passa a ser um caso exemplar de corrupto impune). Breve retrospectiva: no ano passado, o deputado foi acusado de ter sido o operador do "mensalinho" que a gestão de Marta Suplicy é suspeita de ter distribuído a vereadores de São Paulo em troca de apoio a projetos da prefeitura.

A investigação, a cargo do Ministério Público Estadual, continua em curso. Também em 2005, quando veio a público o escândalo do mensalão, o nome de Mentor surgiu, reluzente, na lista dos políticos beneficiados pelo valerioduto. Processado pelo Conselho de Ética da Câmara, foi absolvido em plenário há duas semanas. Na semana passada, outra denúncia desabou sobre o petista: Mentor foi formalmente acusado de ter recebido suborno para beneficiar envolvidos nas investigações da tristemente famosa CPI do Banestado, da qual foi relator entre 2003 e 2004 (veja o quadro). Em depoimento ao Ministério Público Estadual de São Paulo, o doleiro Richard van Otterloo afirmou ter pago 300.000 reais ao petista para não ter seu nome mencionado no relatório final da comissão.

As revelações de Otterloo foram feitas ao promotor Silvio Marques e ao procurador da República Rodrigo de Grandis, responsáveis pelas investigações das contas mantidas no exterior pelo ex-prefeito Paulo Maluf e seu filho, Flávio. Otterloo trabalhou para os Maluf por pelo menos seis anos. Por meio do doleiro Vivaldo Alves, ele recebia dinheiro da conta Chanani (atribuída ao ex-prefeito, em Nova York) em duas contas próprias, a Jazz e a Campari, também em Nova York. Em seguida, repassava o dinheiro aos Maluf no Brasil ("em espécie e acondicionado em malotes", conforme afirmou em depoimento).

Quando, no fim de 2003, as relações entre Maluf e a conta Campari vieram a público, Otterloo preocupou-se com a possibilidade de ter sua participação no esquema investigada pela CPI. Decidiu, então, aceitar a sugestão que, segundo contou ao MP, partiu de Flávio Maluf: a de que procurasse uma determinada pessoa, ligada ao deputado Mentor, que poderia intermediar uma "negociação" para excluí-lo do relatório final da CPI. O Ministério Público deverá ouvir em breve essa pessoa. Otterloo diz ter entregado ao intermediário de Mentor 300.000 reais em dinheiro. Em troca, recebeu o disquete com o relatório final da CPI dias antes de o documento ser divulgado – para ter certeza de que seu nome não estava lá. Os Maluf também foram poupados no relatório de Mentor. O deputado-relator alegou falta de tempo para analisar os documentos relativos à família.

Mentor ganhou a relatoria da CPI do Banestado graças ao ex-ministro da Casa Civil José Dirceu, de quem sempre foi próximo. A indicação era uma forma de o Planalto controlar a comissão, depois de tentativas frustradas de sufocá-la. Antes de eleger-se deputado federal, Mentor era o homem de confiança da ex-prefeita de São Paulo Marta Suplicy. Como líder de seu governo na Câmara, atraiu desde o PMDB até malufistas históricos para a base da prefeita.

Durante o tempo em que permaneceu no cargo, Marta conseguiu maioria para aprovar tudo o que quis. Em julho do ano passado, o ex-tesoureiro do PPS Evaldo Rui Vicentini, em depoimento ao MP, acusou Mentor de ser o "homem da mala" no esquema do mensalinho municipal da petista. A existência do esquema havia sido revelada por VEJA dois meses antes. Mentor, é claro, nega ter participado da compra de vereadores em São Paulo, assim como nega ter sido agraciado com dinheiro do valerioduto. Na semana passada, negou também, é lógico, ter negociado a exclusão de nomes do texto da CPI. Mensalinho, mensalão, compra de votos, venda de relatório: é espantoso como a corrupção teima em perseguir Mentor.

Mr José Mentor (PT-SP) has proposed a bill in July this year calling for the ban on TV fights and martial arts by the television in Brazil. The project, which was presented to the Commission for Tourism and Sport (CTD), was vetoed in early December for failing relationship with the committee. But it can be submitted to another committee, should the Member. 

  

CONTROVERSIAL PAST

One of two things: either the Deputy José Mentor (PT-SP) is pursued preferential nine out of ten accusers emerged in recent political scenario (in which case, all the crimes alleged against him are nothing but slander) or has done very well in attempts to circumvent the law (in which case becomes a textbook example of corrupt unpunished). A brief retrospective: last year, the deputy was accused of being the operator of the "mensalinho" that the management of Marta Suplicy is suspected of having distributed the council of St. Paul in exchange for support for projects in the city. 

  

Research, in charge of the State Public Ministry, is ongoing. Also in 2005, when it came to public scandal mensalão, Mentor's name came up, shining in the list of politicians benefited by valerioduto. Processed by the Ethics Committee of the Board, was acquitted in Parliament two weeks ago. Last week, another complaint fell on PT: Mentor was formally accused of having taken bribes to benefit involved in the investigations of the notorious CPI Banestado, the rapporteur was between 2003 and 2004 (see box). In testimony before the State Public Ministry of São Paulo, the money changer Richard van Otterloo said he paid 300,000 reais to the PT not to have his name mentioned in the final report of the committee. 

  

Otterloo's revelations were made to the developer Silvio Marques and prosecutor Rodrigo de Grandis, responsible for investigations into accounts held abroad by the former Mayor Paulo Maluf and his son, Flavio. Otterloo Maluf worked for at least six years. Through the money changer Vivaldo Alves, he received money from the account Chanani (attributed to former mayor in New York) on two accounts themselves, the Jazz and Campari, also in New York. Then went over the money to Maluf in Brazil (in kind and packed in pouches, "as stated in testimony). 

  

When, in late 2003, relations between Maluf and account Campari became public, Otterloo worried about the possibility of having their participation in the scheme investigated by the CPI. It then decided to accept the suggestion that, according to the MP said, came from Flávio Maluf: that looking for a particular person connected to Mr. Mentor, which could mediate a "negotiation" to exclude him from the final report of the CPI. The prosecutor should hear soon that person. Otterloo says it has delivered to the intermediary Mentor 300,000 in real money. In return, he received the disk with the final report of the CPI days before the document is published - to make sure that his name was not there. The Maluf were also spared in the report of Mentor. Deputy-Rapporteur reported lack of time to review documents relating to the family. 

  

Mentor won the Rapporteur's CPI Banestado thanks to the former chief of staff Jose Dirceu, who was always around. The statement was a way to control the Plateau committee, after unsuccessful attempts to stifle it. Before you get elected Congressman, Mentor was the trusted man of the former mayor of São Paulo, Marta Suplicy. As the leader of his government in the House, drew from the PMDB to Malufista historical basis for the mayor. 

  

During the time that remained in office, Marta was able to approve most everything he wanted. In July last year, former treasurer of the PPS Evaldo Rui Vicentini, in testimony to the MP, accused Mentor to be the "man bag" in the scheme of municipal mensalinho PT. The existence of the scheme had been revealed by Veja two months before. Mentor, of course, denies having participated in the purchase of councilors in Sao Paulo, and denies having been awarded the money valerioduto. Last week, also denied, of course, have negotiated the deletion of names from the text of the CPI. Mensalinho, mensalão, vote buying, selling report: it is amazing how corruption persists in pursuing Mentor.
